Welcome to LYTTEL HELPER. These Terms of Service (“Terms”) govern your use of our website and landscaping services. By accessing our website or engaging our services, you agree to be bound by these Terms.

Please read these Terms carefully before using our services. If you do not agree with any part of these Terms, you must not use our website or services.

Important: These Terms constitute a legally binding agreement between you and LYTTEL HELPER.

Acceptance of Terms

By using our services, you acknowledge that:

You are at least 18 years of age or have parental/guardian consent

You have the legal capacity to enter into binding contracts

You agree to provide accurate and complete information

You will comply with all applicable laws and regulations

Our Services

LYTTEL HELPER provides professional landscaping services throughout Greater Christchurch, including but not limited to:

🏗️ Site Clearance

Professional property clearing and preparation for developers

🌿 Garden Maintenance

Regular tidy-ups, mowing, and ongoing property care

🌱 Landscaping Projects

Design and installation of gardens, planting, and features

🌳 Tree & Hedge Work

Professional tree care, trimming, and hedge maintenance

Note: All services are subject to availability, weather conditions, and property accessibility. Specific service terms will be outlined in individual quotes and service agreements.

Booking Process & Quotes

Quote Requests

  • All quotes are provided free of charge and without obligation
  • Quotes are valid for 30 days from the date of issue unless otherwise stated
  • Final pricing may vary based on site inspection findings
  • We reserve the right to adjust quotes if project scope changes

Service Booking

  • Bookings are confirmed once a deposit is received (where applicable)
  • You must provide accurate property access information
  • A minimum 48-hour notice is required for booking changes
  • Emergency bookings may incur additional charges

Site Access

  • You must ensure safe and clear access to the work area
  • Notify us of any hazards, pets, or access restrictions
  • Provide water and power access where required
  • Inform us of underground utilities or sensitive areas

Payment Terms

Payment Structure

One-off Services (under $500)

Payment due upon completion

Projects ($500 – $2,000)

50% deposit, balance on completion

Large Projects (over $2,000)

33% deposit, 33% at midpoint, 34% on completion

Regular Maintenance Contracts

Monthly invoicing, payment due within 14 days

Late Payment

  • Invoices must be paid within 14 days of issue unless otherwise agreed
  • Late fees of 2% per month may apply to overdue accounts
  • Services may be suspended for accounts over 30 days overdue
  • Debt collection costs will be added to outstanding balances

Cancellation & Refund Policy

Customer Cancellations

More than 48 hours notice

Full refund of any deposit paid

24-48 hours notice

50% cancellation fee applies

Less than 24 hours notice

Full cancellation fee (100% of deposit)

Weather Cancellations

If we cancel due to adverse weather conditions:

  • Service will be rescheduled at no additional cost
  • Full refund available if rescheduling isn’t suitable
  • No cancellation fees will apply

Work in Progress

If you cancel after work has commenced, you will be charged for:

  • All work completed to date
  • Materials purchased or ordered for your project
  • Any disposal or equipment rental costs incurred

Warranties & Guarantees

Service Guarantee

We guarantee that:

  • All work will be performed by qualified and experienced professionals
  • Services will be completed to a high standard of workmanship
  • We will use appropriate tools and equipment for each job
  • Work areas will be left clean and tidy upon completion

Plant Warranties

For planting services:

  • We provide a 3-month guarantee on planted specimens
  • Guarantee applies only with our maintenance service or proper customer care
  • Excludes damage from extreme weather, pests, or neglect
  • Replacement plants are subject to availability

Limitations

Our warranties do not cover:

  • Natural plant mortality or disease beyond our control
  • Damage caused by third parties or acts of nature
  • Issues arising from customer’s failure to follow care instructions
  • Pre-existing conditions not disclosed during initial assessment

Liability & Insurance

Our Liability

LYTTEL HELPER carries full public liability insurance and takes all reasonable precautions to prevent damage. However, we are not liable for:

  • Hidden underground utilities not disclosed or marked
  • Pre-existing structural issues with walls, fences, or paving
  • Damage to unmarked or improperly protected items
  • Indirect or consequential losses
  • Delays caused by weather or circumstances beyond our control

Your Responsibilities

As the property owner or occupier, you must:

  • Disclose all known hazards, utilities, and fragile items
  • Secure or remove valuable items from work areas
  • Ensure pets are secured during service visits
  • Maintain adequate property insurance
  • Report any concerns or damage immediately

Maximum Liability

Our maximum liability for any claim is limited to the total amount paid for the specific service in question, or $5,000 NZD, whichever is less, except where prohibited by law.

Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of LYTTEL HELPERor its content suppliers and is protected by New Zealand and international copyright laws.

You May Not:

  • Reproduce, duplicate, or copy material from our website
  • Redistribute content without our written permission
  • Use our branding, logos, or trademarks without authorization

Photography Rights:

We reserve the right to photograph completed projects for marketing purposes. If you prefer your property not to be photographed, please inform us in writing before work commences.

Dispute Resolution

Resolution Process

Step 1: Direct Communication

Submit a written complaint if issue is not resolved

Engage in good-faith mediation if needed

Step 4: Disputes Tribunal

Legal resolution through New Zealand Disputes Tribunal

We are committed to resolving all disputes fairly and promptly. Most issues can be resolved through direct communication.

Governing Law

These Terms are governed by the laws of New Zealand. Any disputes arising from these Terms or our services will be subject to the exclusive jurisdiction of the New Zealand courts.

These Terms are subject to the Consumer Guarantees Act 1993, Fair Trading Act 1986, and other applicable New Zealand consumer protection legislation. Nothing in these Terms limits your statutory rights.

Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

For significant changes, we will make reasonable efforts to notify customers via email or website announcement.

Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of law, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
